1. Who we are

These Terms & Conditions (“Terms”) are between you and Peotech Group, Eagle Trace Estate, Fourways, 2191 (“Albumdrop”, “we”, “us”). By using the Albumdrop platform and publishing releases, you agree to these Terms.

2. The service

Albumdrop provides creator tools across Albumdrop and Mixdrop, including release and mix pages, listener discovery surfaces, supporter and subscriber capture, community interactions, and digital content delivery features. We are not a record label, distributor, publisher, or store.

Features, limits, and availability can vary by plan and may change over time. We may introduce, modify, or retire functionality as part of operating and improving the service.

3. Your content

You retain ownership of your music, artwork, and branding. You grant Albumdrop a limited, non-exclusive license to host, display, and distribute your content solely to operate the service and provide your landing pages and downloads.

You confirm that you have all rights to upload and distribute the content you publish.

4. Prohibited content

You may not publish content that is unlawful, infringing, deceptive, or harmful. We may remove content or suspend accounts that violate these Terms or applicable law.

5. Payments & fees

Platform fees, gateway fees, taxes, and third-party processing costs may apply depending on your plan and selected payment setup. Paid plans may include additional billing options, while entry plans may use the platform gateway by default.

Subscription upgrades, renewals, and plan changes are processed through supported providers. A pending, failed, or reversed payment does not grant permanent paid-plan entitlement, and we may limit paid features until successful settlement is confirmed.

You are responsible for all taxes and reporting obligations related to your earnings.

6. Payouts

For platform-gateway artists, payouts are processed weekly to a verified PayPal payout account once your available balance clears the hold window and meets the minimum payout threshold (USD-equivalent). Funds are held for 14 days before becoming payout-eligible. Artists using a connected gateway receive funds directly through their gateway, outside the platform payout system.

7. Refunds & chargebacks

Albumdrop does not provide refunds. Refunds, disputes, chargebacks, and payout/dispute-related provider fees are the responsibility of the artist and are subject to the policies of the payment provider.

8. Availability & changes

We may change or suspend features to improve the service or comply with legal requirements. We will make reasonable efforts to keep the service available but do not guarantee uninterrupted access.

9. Disclaimer

The platform is provided “as is” and “as available”. We make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Albumdrop is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the fees paid to us in the three months preceding the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold Albumdrop harmless from claims arising out of your content, your use of the service, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of South Africa. You agree to the exclusive jurisdiction of the courts of South Africa for any dispute arising from these Terms or the service.

14. MixDrop clause (DJ mixes)

By uploading mixes to Mixdrop, you confirm you hold all required rights, licenses, and permissions for all audio used. You are solely responsible for legal compliance of uploaded mixes.

You grant Albumdrop a non-exclusive, worldwide, royalty-free license to host, stream, reproduce, display, and promote your Mixes within the service while they remain hosted.

Albumdrop does not claim ownership of your mixes and does not assume responsibility for clearing third-party rights.

Prohibited Mixdrop content includes unauthorized copyrighted content, resale/direct monetization without rights, copyright-law violations, and rights-evasion techniques (including masking, splitting, or mislabeling).

Mixdrop is stream-first. Mixes containing third-party copyrighted content may not be sold or downloaded unless you hold full rights. Albumdrop may remove content on valid notice, remove suspected infringing content proactively, and suspend repeat infringers.

Albumdrop acts as a hosting platform for user-generated content and does not pre-screen all uploads. You agree to indemnify Albumdrop for claims arising from your uploaded mixes.
